UPON hearing counsel the Court made the following O R D E R I.A.No.2757: In this application, the State of Orissa seeks permission to remove the dead and dry bamboo clumps from Satkosia Tiger Reserve and allow the bamboo to be used for bonafide requirements of the local people living in and around Satkosia Tiger Reserve through the State Forest Development Corporation. The matter has been examined by the C.E.C. and it has recommended the removal of gregariously flowered Daba bamboo on fulfillment of the following conditions: 1. The felling and the removal of the flowered bamboo will be done by engaging only the EDCs and the VSSs located within the protected area and those located in the immediate vicinity. The material so felled will be kept in small decentralized depots; 2. The felled bamboo will be distributed to the villagers located within the protected area and in the immediate vicinity free of cost based on a plan to be prepared in this regard by the Orissa Forest Department. No 4 commercial exploitation or sale to industry will be permissible; 3. rigid fire prevention measures, tending operations and soil and moisture conservation measures will be taken to ensure the establishment of regeneration and to prevent accelerated soil erosion and moisture loss; and 4. no labour camp will be established close to any water hole are stream used by the wild animals. Adequate precautions will be taken so that the wildlife habitat is not disturbed by the people involved in the felling of bamboo. All the conditions imposed by CEC are acceptable to the State Government. The exercise will be supervised by EDCs and VSSs located in the State. The application is disposed of accordingly. Learned Attorney General for India stated that the Ministry of Environment & Forests will take a decision under the Forest Conservation Act and shall consider granting permission subject to the following conditions : 1. The applicant shall deposit a sum of Rs.55 crores towards five times of the normal NPV (as recommended by the CEC) with interest @9% per annum from 1st April, 2007, till the date of payment. Such payment shall be made in totality in one instalment within 4 weeks from the date of the order. 2. An SPV shall be set up under the Chairmanship of the Chief Secretary, Meghalaya with the Principal Chief Conservator of Forests, Meghalaya, Tribal Secretary, Meghalaya, Regional Chief Conservator of Forests, MoEF at Shillong and one reputed NGO (to be nominated by the MoEF) as Members. The SPV will be set up within 4 weeks. 3. The User Agency will deposit with the SPV a sum of Rs.90/- per tonne of the limestone mined from the date on which mining commenced within 4 weeks of the SPV being constituted. 4. The SPV shall follow the principles and procedure presently applied for utilization of CAMPA money. The account will be audited by the Accountant General, Meghalaya. The money will be kept in interest bearing account with a Nationalized Bank. The Accountant General and the SPV shall file an Annual Report before this Hon'ble Court detailing all the work done by it in relation to the welfare projects mandated upon it including the development of health, education, economy, irrigation and agriculture in the project area of 50 kms. Solely for the local community and welfare of Tribals. 3 5. The User Agency will comply with all the conditions imposed on it earlier as well as further recommendations made by the Committee constituted by the MoEF under the order dated 30th march, 2010, including, in particular, the following : (a) It shall prepare a detailed Catchment Area Treatment Plan. (b) It shall explore the use of surface miner technology. (c ) It shall monitor ambient area quality as per New National Ambient Air Quality Standards. (d) It shall take steps to construct a Sewage Treatment Plant and Effluent Treatment Plant. (e) It shall discontinue any agreement for procuring limestone on the basis of disorganized and unscientific and ecologically unsustainable mining in the area. (f) It shall prepare a comprehensive forest rehabilitation and conservation plan covering the project as well as the surrounding area. (g) It shall prepare a comprehensive Biodiversity Management Plan to mitigate the possible impacts of mining on the surrounding forest and wildlife. (h) It shall maintain a strip of at least 100 meter of forest area on the boundary of mining area as a green belt. 6. The MoEF shall take a final decision under the Forest Conservation Act, 1980 for the revised environmental clearance for diversion of 116 hectares of forest land, taking into consideration all the conditions stipulated hereinabove and it may impose such further conditions as it may deem proper. The felling down of the trees and the constructions would also have an adverse impact on the bird sanctuary lying very closely to the site of the project. This aspect of the matter was not properly examined by the Ministry of Environment & Forests (MoEF) as the project site, in its opinion, was not a forest area. However, in the affidavit filed by the MoEF before this Court it was stated : "....in case the Hon'ble Supreme Court desires this project to be appraised from environmental angle, MoEF will be able to appraise the project based on the details and documents to be prepared and submitted by the project proponent (U.P.Government/ NOIDA) and submit its recommendations including the necessary environmental safeguard measures require to minimize the likely adverse environmental impacts...." MoEF is directed to make a study of the environmental impact of the project as stated in paragraph 4 of its affidavit. It should also suggest measures for undoing the environmental degradation, if any, caused by the project and the amelioration measures to safeguard the environment, with particular reference to the adjacent bird sanctuary. (PGCIL) seeking permission for the use of 0.552 ha. of 4 land falling within the Chandaka Wildlife Sanctuary in Orissa for the laying of the 400 KV Baripda-Mendhasal Transmission Line. CEC has examined the matter and recommended for the approval of the project on fulfillment of the following conditions : a) for the use of the forest land, approval under the FC Act will be obtained; b) the NPV as per rates applicable for the forest land falling in the National parks/Sanctuaries will be deposited by the User Agency; and c) the conditions on which the project has been cleared by the Standing Committee of the National Board for Wild Life will be strictly complied with. Subject to fulfillment of the above conditions by the PGCIL the project is cleared. I.A. is disposed of accordingly. I.A.No.2846: This application is filed by the Power Grid Corporation of India Ltd. (PGCIL) seeking permission for the use of 241.597 ha. of land falling in the Wild Ass Sanctuary in Kutch District, in Gujarat for the construction of the three double circuit transmission lines to extract power from the 4000 MW Mundra Ultra Mega Power Project. The CEC has examined the matter and recommended the approval of the project on fulfillment of the following conditions : i) for the use of the forest land, approval under the FC Act will be obtained and the NPV will be deposited as per the rates applicable for the use of the forest/non-forest land falling within the Sanctuary; 5 ii) the conditions on which the project has been recommended by the Chief Wildlife Warden, Gujarat and the Standing Committee of National Board for Wildlife will be strictly complied with; and iii) 5% of the project cost of Rs.85.87 crores for the portion of the transmission lines falling in the Sanctuary I.e. Rs.4.294 crores will be deposited by the user agency in the Compensatory Afforestation Fund for undertaking conservation and protection work in the Wildlife Sanctuary; Subject to fulfillment of the above conditions by the PGCIL the project is cleared. I.A. is disposed of accordingly. I.A.No.1137: Heard both sides. The C.E.C. has filed a fresh report regarding the land to be allotted to tribals. In principle, the proposal put forward the by the Kerala Government is accepted. These lands were originally private forests and these were statutorily vested with the Government pursuant to the Kerala Private Forests (Vesting and Assignment) Rules, 1974 as part of the implementation of the Land Reforms Act. It was also agreed that these would be given to the people for assignment for agricultural purposes as per the provisions of the Land Reforms Act. In view of the peculiar circumstances of this case, we accept the proposal but the concerned Department of the State is given three months time to examine the individual forest lands and assess the extent of land covered by the Forest Act and reassess the extent of land to be included in the 6 proposal for rehabilitation of the landless tribals. It is also brought to the notice by learned counsel appearing for the State that in the land to be assigned to the tribals no occupants would be allowed to cut timber trees. The question of payment of NPV is left open to be decided after the assignment is made. This is a one time exercise and not to be treated as a precedent in Kerala or any other State. List the I.A. after three months. And other parties. The C.E.C. has filed a report in this Court. On 18.5.2007, this Court had directed to grant licenses for reopening of the saw mills falling under Categories I to III. The present report relates to category IV. The C.E.C. in its report has opined that fresh licenses may be granted subject to the following conditions : The saw mill was established prior to July, 1989 and the license fee was deposited with the U.P.Forest Department prior to 04.03.1997 and the license fee up to the year 1995 has also been deposited with the U.P.Forest Department in respect of 90 saw mills and no offence case, pursuant to the illegal use of transportation is pending 7 against the holder of license; further, in addition to the normal saw mill, licensee fee/renewal fee, they will deposit a sum of Rs.50,000/- each as one time measure to be refunded. This amount will be kept in an interest bearing deposit in a nationalized bank and will be released after getting approval by this Court. In re : Plywood & Veneer: The following conditions have been imposed by the C.E.C.: (I) the seniority list of plywood/veneer units established after 4.3.1997 (Category IV units) should be finalized by the State Level Committee for Uttar Pradesh Wood Based industries in consultation with the C.E.C. The said list should be finalised after giving wide publicity to the provisional seniority list, inviting objections from the affected parties, giving personal hearing to them and after considering the objections/submission made by them; (ii) after meeting the requirement of the licensed wood based industry, the units permitted by this Hon'ble Court and the units whose category is yet to be finalised, the plywood/veneer units falling in category IV may be considered for grant of license to the extent of timber availability and strictly in the order of seniority, subject to the one-time payment of Rs.9 lakhs per press in respect of the veneer units and compliance of the other conditions that have been stipulated. The one-time payment of penalty will be in addition to the normal licence fee and the other charges, if any, payable to the U.P.Forest Department. As decided earlier, the above said amount should be kept in a designated interest bearing bank account and should be utilized only after the scheme in this regard is approved by this Hon'ble Cout; and (iii) in case the timber availability is found to be inadequate for all the plywood/veneer units falling in Category IV, the permission granted to the plywood unit should be restricted to one press whereas for the veneer unit it should be restricted to one peeler only. In addition, the plywood units may be permitted one peeler each, if it had one or more peeler functional in the unit before it was closed. Learned counsel for the State of U.P. has got certain objections regarding these recommendations. In case the State has any problem, it would be at liberty to approach this Court again. Subject to 8 these, the recommendations of C.E.C. are accepted and appropriate action would be taken accordingly. IA.Nos.2750-52: State of U.P. shall file its reply within four weeks, as a last opportunity.
