      These    applications       are      filed      by     Samata      Nagar    Co-op    Housing

Society.      The Society contends that the land on which they plan to

construct new buildings does not form part of the Forest Land.                                   The

CEC has submitted its report.                 A copy of the letter dated August 7,

2009,   addressed      by   the      Joint    Secretary           (Forests),      Government     of

Maharashtra to the Member Secretary, CEC, was also produced before

us.     In    this    letter    it    is     stated        that    the    owner    of   the     land

admeasuring 52.30 acres was issued a notice under Section 35(3) of

the Indian Forest Act, 1972, on April 25, 1957.                           Later, vide Gazette

Notification dated December 15, 1962, this land was de-notified from

the provisions of the above section and was acquired for public

purposes     i.e.     for   a   housing       scheme        of    the    Maharashtra       Housing

Development     Board/Authority            (MHADA).          Hence,      the     effect    of   the

Section 35/3 notice ceased to be in operation.                           The land was handed

over to MHADA on June 9, 1969, and then a number of houses were

constructed over it which are now in a highly dilapidated condition.

The applicant-Society wants to construct new houses in this area

with the permission of the MHADA.                      The land in question is not a

forest land and no specific sanction is required.

      We accept the Report of CEC dated July 13, 2009.

      The State is permitted to give effect to its Order dated March

19,   2008,      by    withdrawing         its       later    order      passed    on     December

29,2008, regarding the correction of land records.

      The applications are disposed of accordingly.

  1. 5% of the estimated cost of the project will be deposited in
     the Compensatory Afforestation Fund for conservation and
     protection of National Chambal Crocodile Sanctuary in the State
     of Madhya Pradesh; and
  2. the conditions stipulated by the Chief Wildlife Warden will be
     strictly complied with.



            The State Government is agreeable to the aforesaid

conditions.        On   complying     with       the   same,   the   project      is

approved.    I.A. is disposed of accordingly.

            The   Irrigation        Department    of   the   State    of   Uttar

Pradesh is seeking permission for construction of an embankment

on the left bank of the river Ganga from village Sherpur to

village Theg falling in the Hastinapur Wildlife Sanctuary.                   The

C.E.C.    has   examined      the   proposal     and   has   recommended     the

following recommendations subject to which permission may be

granted:



     1.     Approval of the Standing Committee of the NBWL shall

     be obtained before starting any work on the project;



     2.     5% of the estimated project cost of Rs.24.58 crores

     will be deposited in the Compensatory Afforestation Fund

     for implementing the mitigative measures, suggested by the

     CWLW, in the sanctuary;

     3.           for   the    use    of   the   non-forest    land    falling

     within the sanctuary, the NPV will be deposited as per the

     Hon'ble Court's order dated 28.3.2008 in the NPV matter;

     and

     4.           the conditions stipulated by the Chief Wildlife

     Warden will be strictly complied with.

The above conditions are acceptable to the State Government.

Subject to fulfillment of the above conditions, the project is

approved.
